What Is SB100?

SB 100 prevents public higher education institutions in South Dakota from restricting the lawful carrying, possession, storage or transportation of concealed firearms and other self-defense items by individuals with the appropriate permits. It also establishes limited exceptions where restrictions may apply for safety and security reasons. 

Individuals may only concealed carry with the required Restricted Enhanced Permit or Enhanced Permit; open carry is not authorized.

USD – Request for Hazardous Materials Exception to Concealed Carry

South Dakota Board of Regents Policy 1.4.5 allows the universities to restrict the concealed carry of pistols and compatible ammunition and other self-defense items in clearly designated portions of buildings or structures where the following items are present:

  • More than fifty-five gallons of flammable liquid, as identified in 29 C.F.R. § 1910.106 (January 1, 2025)
  • Significant quantities of hazardous materials classified as Category 3 or higher by the 704 Hazard Identification System of the National Fire Protection Association
  • K-size cylinders containing corrosive, reactive, flammable, toxic, or oxidizer gases classified as Category 2 or higher by the 704 Hazard Identification System of the National Fire Protection Association
  • L-size cylinders of acetylene gas
  • Magnetic resonance imaging equipment or nuclear magnetic resonance equipment

The university has identified areas where these items are present and displayed signage noting the restricted area. Rooms, wings, and sections identified with appropriate signage indicate areas where concealed pistols and compatible ammunition, stun guns, and mace, pepper spray and chemical irritants may not be possessed or carried pursuant to SDCL 13-53-57.

If the above-described materials are present in a lab, classroom, or other space within your control, you may request that the University designate the space as restricted by submitting the request form below to: USD Office of Environmental Health & Safety ([email protected]).

In addition to the completed request form, more information, including a Hazardous Materials Inventory, will be requested by the USD Office of Environmental Health & Safety. Any restriction must be approved by the University President in writing. If approved for restriction, Environmental Health & Safety will provide appropriate signage as required by SDBOR Policy.
