The justices – all graduates of the USD School of Law – will hear nine oral arguments during the three-day March Term of Court at the law school courtroom. Oral arguments on Monday, March 24 include: State of South Dakota vs. Sean Whistler, 9 a.m., Deborah Isack, individually, and as Guardian and Conservator for Terry D. Isack vs. Acuity, 10 a.m., and Roger Hamilton vs. Richard A. Sommers, Melissa E. Neville and Bantz, Gosch & Cremer, Prof, LLC, 11 a.m.

Oral arguments scheduled for Tuesday, March 25 are Megan Ruschenberg, Jessica Cornelius and Heather Rensch vs. David Eliason and Annabelle’s Adult Super Center of South Dakota, LLC and Olivia’s of South Dakota, LLC d/b/a Olivia’s Adult Super Store, 9 a.m.; Donovan Craig Siers vs. Douglas Weber, Warden of the South Dakota State Penitentiary, 10 a.m.; and Paul Nelson Farm vs. South Dakota Department of Revenue, 11 a.m. Oral arguments for Wednesday, March 20 include: State of South Dakota vs. Derek Boe, at 9 a.m.; Stern Oil Company and State of South Dakota Ex rel Stern Oil Company vs. Border States Paving, Inc., and Liberty Mutual Insurance Company, as its surety at 10 a.m.; State of South Dakota vs. Donald Leon Nekolite,11 a.m.

Chief Justice David Gilbertson (USD School of Law, ’75) and Justices John Konenkamp (’74), Steven Zinter (’75), Glen Severson (’75) and Lori Wilbur (’77) will hear oral arguments each morning with afternoon sessions reserved for written appellate briefs. Case synopses will also be available each morning for the public. The Supreme Court will also review four non-oral arguments during the March session. The South Dakota Supreme Court employs security methods to insure the well-being of all who attend its proceedings. All people attending the morning arguments will need to enter through the Law School building’s southeast door. Book bags, backpacks, and other packages are subject to search and people are encouraged not to bring them to keep the entrance process smooth and without delays. Individuals requiring assistance should contact the State Court Administrator’s Office at (605) 773-3474 at least 48 hours before the session to make any arrangements.
