Disability Accommodations for Employees
The University of South Dakota provides an accommodating environment for those with disabilities.
As required by Section 504 of the Rehabilitation Act and the Americans with Disabilities Act, we:
- Prohibit discrimination against qualified students, faculty, staff, and visitors with disabilities.
- Reduce or eliminate physical, academic, and attitude barriers for people with disabilities.
To request disability accommodations, please submit the request through our ADA One Stop Article (Requesting Accommodations Under the Americans With Disabilities Act (ADA)).
We rely on faculty and staff to ensure that people with disabilities are not discriminated against and that people with disabilities have equal access to all of its programs and activities. Both the university and our employees have rights and responsibilities to ensure our university community delivers disability accommodations.

Employee Rights
- Employees have a right to expect all disability-related information to be treated confidentially.
- Human Resources is the only office designated to review disability documentation for faculty and staff to determine eligibility and appropriate accommodations.
- Employees have a right to receive reasonable and appropriate accommodations in a timely manner from Human Resources.
- Employees have a right to appeal decisions regarding services and accommodations.
Employee Responsibilities
- Employees have a responsibility to provide Human Resources with appropriate documentation of their disability.
- Employees have a responsibility to initiate discussions with their supervisor and Human Resources concerning accommodation requests.
- Employees have a responsibility to initiate requests for accommodations in a timely manner.
- Employees have a responsibility to inform Human Resources immediately when an accommodation is not being provided completely or correctly.
- Employees have a responsibility to notify Human Resources when an accommodation is not being used or is no longer needed.
Human Resources Rights
- Human Resources has a right to receive the appropriate documentation from the employee prior to services being initiated.
- Human Resources has a right to deny unreasonable accommodations.
- Accommodations cannot impose undue hardship to, or fundamentally alter, a program or an activity of the University.
- Human Resources has a right to deny accommodations if appropriate documentation is not provided.
Human Resources Responsibilities
- Human Resources has a responsibility to collect, evaluate, and securely house disability documentation and determine eligibility for service.
- Human Resources has a responsibility to treat and protect all disability-related information confidential.
- Human Resources has a responsibility to meet with employees privately in an accessible location to discuss disability-related needs.
- Human Resources has a responsibility to provide reasonable and appropriate accommodations in collaboration with an employee and their supervisor.
